Estate Planning (Disability and Other Directives)

Living Will. A living will is an advance directive that a person can create during their lifetime with respect to medical treatment if they develop a terminal condition and are unable to communicate decisions concerning their treatment. In Illinois, a person has the right to make an advance directive for withholding or withdrawing medical treatment if their condition is terminal. We can prepare a Living Will for you, in conjunction with your estate plan if you would like to create an advance directive.

Power of Attorney - Property. A power of attorney for property permits an individual to appoint an agent to make decisions concerning their property in the event they become incapacitated. Essentially, it provides for managements or your property to protect it during your incapacity. For example, bills can be paid, insurance can be purchased or renewed, contracts can be signed should an individual need to reside in a rehab center or nursing home and social security disability benefits can be applied for while you are incapacitated. Additionally, if you have a Revocable Living Trust and you did not completely transfer your assets to the trust during your lifetime, your agent can handle the transfers for you. We often recommend this type of power of attorney for our clients and can assist you with preparing one for your estate plan.

Power of Attorney - Healthcare. A power of attorney for healthcare permits an individual to appoint an agent to make personal healthcare decisions on their behalf in the event they become incapacitated. In most circumstances, the agent will have broad powers to determine the medical care and treatment that is appropriate for you. We can recommend a Healthcare Powers of Attorney for you and will assist with preparation of the proper document for your estate plan.

Special Limited Power of Attorney for Business Matters. This type of power of attorney allows you to appoint an agent to make specific decisions with respect to your business, in the event of your incapacity. We often recommend this estate planning tool to our clients who are sole proprietors or partners in business ventures.

Anatomical Gifts. The Uniform Anatomical Gift Act designates several categories of gifts which you may want to make for transplantation purposes or for general science. We can prepare and provide the proper forms for you, if you would like to include anatomical gifts in your estate plan.
